These Terms and Conditions set out the basis on which Rubbish Removal Bromley provides rubbish removal, waste collection and related services to residential and commercial customers. By booking a service, placing an order, or allowing our team to carry out work at your property, you agree to be bound by these Terms and Conditions.
If you do not agree with any part of these Terms and Conditions, you should not proceed with a booking or use our services.
In these Terms and Conditions, the following definitions apply:
Customer means the person, business, or organisation that requests or receives services from Rubbish Removal Bromley.
We, us, our means Rubbish Removal Bromley as the provider of rubbish removal and waste collection services.
Services means any rubbish removal, waste clearance, collection, transportation, and associated activities carried out by us.
Booking means a request by the Customer for Services that has been accepted by us, whether made by phone, email, online form, or in person.
Waste means any items, materials, or rubbish which the Customer asks us to remove, excluding prohibited or hazardous waste as defined in these Terms and Conditions and under relevant waste regulations.
We provide rubbish removal and waste collection services for domestic and commercial premises. This may include collection of household waste, garden waste, bulky items, office waste, and construction or renovation debris, subject to applicable laws and these Terms and Conditions.
The precise scope of any Booking, including the type and approximate volume or weight of Waste, the collection address, and the agreed date and time window, will be confirmed at the time of Booking. We reserve the right to amend the agreed scope if the Waste presented on arrival is materially different from that described when the Booking was made.
Bookings may be made by telephone, email, or through our online enquiry or booking process. When making a Booking, the Customer must provide accurate details, including:
The full collection address and any access restrictions.
A description of the type and amount of Waste to be removed.
Any items that may be heavy, bulky, or require special handling.
The preferred date and time window for collection.
A Booking is only confirmed once we have accepted it and communicated confirmation to the Customer. We may refuse or cancel a Booking at our reasonable discretion, for example if the requested service is not available, the Waste is prohibited or hazardous, or the property is not safely accessible.
We may conduct an assessment on arrival to confirm the quantity and type of Waste. If the Waste is substantially more than stated, or of a different type, we may adjust the price, offer an alternative service, or decline the work.
The Customer is responsible for providing safe and reasonable access to the collection point for our team and vehicle. This includes ensuring that any gates, doors, or communal entrances can be opened, that parking or loading space is available as needed, and that the Waste is accessible without risk to health and safety.
The Customer must ensure that:
The Waste to be collected is clearly identified and segregated from any items not intended for removal.
No prohibited, restricted, or unsafe items are included in the Waste unless previously agreed in writing and in accordance with relevant regulations.
Pets, children, and other persons are kept clear of work areas while our team is operating.
If we are unable to access the property or the Waste due to circumstances within the Customer's control, we may treat the visit as a failed collection and charge a call-out or cancellation fee in accordance with Section 7 of these Terms and Conditions.
Our pricing is generally based on factors including the type of Waste, its estimated volume or weight, the time required, and access conditions. Any quote given before we attend the property is an estimate only, based on the information provided by the Customer.
On arrival, our team will assess the actual Waste and confirm the final price before commencing work. If the Customer does not agree to the revised price, we are not obliged to carry out the collection and may apply a reasonable call-out charge to cover our costs.
Prices are given in pounds sterling and may be subject to applicable taxes. We reserve the right to update our prices, fees, and charging structure at any time. Any change will not affect confirmed Bookings that have already been accepted, except where the information provided by the Customer was inaccurate or incomplete.
Unless otherwise agreed, payment is due in full on completion of the collection, either before or immediately after the Waste is loaded onto our vehicle. We may request full or partial payment in advance, particularly for larger or commercial jobs.
We accept various forms of payment, which may include cash, card payment, or bank transfer. The specific payment methods accepted may be confirmed at the time of Booking. Where payment is to be made by invoice, the Customer agrees to pay all invoices within the stated payment terms.
If payment is not received by the due date, we may:
Charge interest on overdue sums at a reasonable commercial rate.
Suspend further services until payment is made in full.
Recover all reasonable costs incurred in pursuing payment, including legal and collection costs.
The Customer may cancel or amend a Booking by contacting us as early as possible.
If the Customer cancels more than 24 hours before the agreed collection time, we will not normally charge a cancellation fee.
If the Customer cancels within 24 hours of the agreed collection time, we reserve the right to apply a reasonable cancellation charge to cover our costs and any lost opportunity.
If our team attends the property at the agreed time and is unable to complete the collection due to the Customer's act or omission, including but not limited to:
Failure to provide access.
The Waste not being available.
The Waste being materially different from that described and the Customer refusing revised pricing.
We may treat this as a failed collection and charge a call-out fee or cancellation charge.
We will use reasonable efforts to attend and complete collections within agreed time windows, but times are estimates only. We are not liable for delays caused by traffic, weather, access issues, or other circumstances beyond our reasonable control.
We operate in accordance with applicable waste management regulations in the United Kingdom. Certain waste types are restricted or require special handling, licensing, or documentation. The Customer must inform us in advance if any such items are to be included in the Waste.
Without limitation, prohibited or restricted items may include:
Hazardous or toxic materials.
Certain chemicals, oils, paints, and solvents.
Asbestos or materials containing asbestos.
Clinical or medical waste, including sharps.
Gas cylinders, pressurised containers, and certain electrical items.
Any item for which special permits or arrangements are required.
We reserve the right to refuse to collect any Waste that we reasonably believe to be hazardous, illegal, or unsuitable, or that could cause damage to property, vehicles, or the environment. If such items are discovered after loading, we may unload them safely at the collection point or an appropriate location and notify the Customer.
Once the Waste has been loaded onto our vehicle and payment has been made, title and responsibility for the Waste transfers to us, subject to these Terms and Conditions and applicable laws.
We are committed to handling, transporting, and disposing of Waste in a lawful and environmentally responsible manner, using licensed facilities where required. Our services are designed to comply with relevant waste duty of care obligations.
The Customer confirms that they have the right to give us the Waste for collection and that the Waste does not include any items that are stolen, unlawfully obtained, or in breach of third-party rights. The Customer will be responsible for any claims, losses, or penalties arising from breach of this confirmation.
We will use reasonable care and skill when carrying out our Services. However, the Customer is responsible for protecting any surfaces, fixtures, or fittings that may be at risk during the removal process, such as delicate flooring, walls, or door frames.
Where access is tight or the Waste is particularly heavy or awkward, there is a risk of minor damage. Provided we act with reasonable care, we shall not be liable for minor cosmetic damage or wear and tear arising from normal removal operations.
The Customer should inform us in advance of any particular risks, valuable items, or sensitive areas. We will not be responsible for loss or damage to items that were not clearly identified or that were mixed with the Waste.
Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter which cannot be excluded or limited under applicable law.
Subject to the above, our liability to the Customer in connection with the Services, whether in contract, tort, or otherwise, shall be limited to the total amount paid or payable by the Customer for the specific Booking giving rise to the claim.
We shall not be liable for:
Any indirect, consequential, or special loss or damage.
Loss of profits, revenue, business, or anticipated savings.
Any loss arising from delay or failure to perform where such delay or failure is due to events beyond our reasonable control, including but not limited to severe weather, traffic disruption, road closures, accidents, strikes, or equipment failure.
If the Customer is dissatisfied with any aspect of our Services, they should contact us as soon as possible so that we can investigate and seek to resolve the issue.
We may ask for details of the Booking, the nature of the complaint, and any supporting information. We will aim to respond within a reasonable timeframe and may propose corrective action where appropriate.
Any claim relating to damage to property or failure to perform the Services must be notified to us promptly and, in any event, within a reasonable period after completion of the collection, so that we can investigate while evidence is still available.
We collect and process personal information provided by the Customer for the purposes of arranging and delivering our Services, handling payments, and managing customer relationships. We will handle such information in accordance with applicable data protection laws in the United Kingdom.
We will take reasonable steps to keep personal data secure and will not sell or share your details with unrelated third parties except where necessary to provide the Services, comply with legal obligations, or enforce these Terms and Conditions.
We may update or amend these Terms and Conditions from time to time. Any changes will take effect from the date they are published or otherwise communicated and will apply to new Bookings made after that date.
The version of the Terms and Conditions that applies to a particular Booking will normally be the version in force at the time the Booking was confirmed. It is the Customer's responsibility to review the current Terms and Conditions before making a Booking.
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or with the Services, shall be governed by and construed in accordance with the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or related to these Terms and Conditions or the provision of our rubbish removal and waste collection services.
If any provision of these Terms and Conditions is held to be invalid, unlawful, or unenforceable, that provision shall be deemed severed to the extent necessary, and the remaining provisions shall continue in full force and effect.
No waiver by us of any breach of these Terms and Conditions shall be considered a waiver of any subsequent breach of the same or any other provision.
No third party shall have any rights to enforce any term of these Terms and Conditions, whether under legislation relating to third party rights or otherwise.
These Terms and Conditions constitute the entire agreement between the Customer and Rubbish Removal Bromley in respect of the Services and supersede any prior understandings, representations, or agreements, whether oral or written, relating to the subject matter.
